While I am certainly no fan of child pornography--our Government's more and more pervasive use of forfeiture laws is disturbing.
Go to "forfeiture.gov" to see the 700+ pages of property the Gov. has seized from its citizens and plans to keep. Innocent owners will get their day in court to TRY
and get their property back, but it's been ruled that "four years is
not too long to wait" (see US v Phillips)---and because the laws are so complicated, if you are an innocent owner, you most definitely should hire an attorney--just to get your own property back. Watch the Gov. ratchet this up and up. It's a money maker.Anonymousnoreply@blogger.comtag:blogger.com,1999:blog-21633793.post-15484230790852513442010-06-04T20:03:28.072-04:002010-06-04T20:03:28.072-04:00So how is it fair to extort $95,000 from the innoc...So how is it fair to extort $95,000 from the innocent wife? I doubt the defendant cares. He's going to prison for a number of years and is probably getting divorced anyways, so should he care? The wife would probably get it all anyways in a divorce.

But now a completely and totally innocent person gets screwed over by the government. I am sure she spent time and effort in making the house look nice, etc. And probably some of her own money, too.

If I was her I'd burn the damn thing to the ground and toss the keys in the ashes.Anonymousnoreply@blogger.comtag:blogger.com,1999:blog-21633793.post-64248297146281640872010-06-03T15:58:14.963-04:002010-06-03T15:58:14.963-04:00Anonymous said:

The punishment does not have to be the equivalent to someone else's it just has to be fair.Detective Wnoreply@blogger.comtag:blogger.com,1999:blog-21633793.post-5577471340667300382010-06-03T01:33:21.376-04:002010-06-03T01:33:21.376-04:00So the government extorts $95,000 from a woman who...So the government extorts $95,000 from a woman who had nothing to do with the porn. Caused a lot of water cooler talk about how great it would be to take some of these guy's homes. I think there are probably better cases to use forfeiture on, usually the wives are completely clueless about their husband's activities.

I would also caution posters that these acts shouldn't be described as "fucking" since that implies some sort legitimate relationship. Raping would be a more appropriate term.Detective Wnoreply@blogger.comtag:blogger.com,1999:blog-21633793.post-7940837800777376322010-06-01T11:21:45.520-04:002010-06-01T11:21:45.520-04:00It seems likely to me that using forfeiture was th...It seems likely to me that using forfeiture was the governments way of assuring a fine was paid even if Hull didn't have financial assets to pay otherwise.
